Welcome to Host My Vacation. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and HostMyVacation LLC (“Host My Vacation,” “we,” “us,” or “our”), a company registered at 126 Franklin Ave, New Rochelle, NY 10805, USA.

By accessing or using the website located at https://www.hostmyvacation.com/ (the “Platform”), or by utilizing any of our travel-related services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the Platform and our services.

Host My Vacation operates as an Online Travel Agency (OTA) and global travel marketplace. We provide a platform that facilitates the booking of vacation homes, private rentals, hotels, flights, car rentals, and integrated experiences.

To access certain features of the Platform, you may be required to register for an account.

Legal Capacity: By creating an account or booking travel services through the Platform, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into a binding contractual agreement. Minors are strictly prohibited from utilizing the booking features of this Platform.

Sanctions & Export Control Compliance: You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, nor are you listed on the U.S. Treasury Department's list of Specially Designated Nationals or any other applicable government sanction list.

By creating an account, you agree to:

• Provide accurate, current, and complete information during registration and keep your account details updated.
• Maintain the strict confidentiality of your account credentials (username and password).
• Accept full responsibility for all activities that occur under your account.
• Immediately notify Host My Vacation of any unauthorized use of your account or any other breach of security.

When booking accommodations, flights, or other travel services through the Platform, Travelers must follow the step-by-step checkout process.

Confirmation: A booking is only considered finalized and confirmed once the Traveler receives a formal booking confirmation email containing a reservation number from Host My Vacation.

Pricing & Errors: All prices displayed on the Platform are in United States Dollars (USD) unless explicitly stated otherwise. Prices are subject to change without notice until a booking is confirmed. In the event of an obvious typographical error or a system error resulting in an incorrect price display, Host My Vacation reserves the right to correct the price or cancel the booking without penalty or liability, even after a confirmation email has been issued.

Travel Documentation and Advisories: It is the Traveler's sole responsibility to ensure they meet all foreign entry requirements, including obtaining necessary passports, visas, and health vaccinations. Host My Vacation accepts no liability if you are denied boarding or entry into a country.

Payment Gateway Compliance: Payments are processed through secure, PCI-compliant third-party payment gateways. Host My Vacation does not directly store full credit card numbers on our servers.

Authorization: By submitting payment details, you explicitly authorize Host My Vacation and its designated payment processors to charge your provided credit card, debit card, or other payment method for the total booking cost.

Payment Security: Host My Vacation relies on established, PCI-DSS compliant third-party payment processors to handle financial data securely. While we employ commercially reasonable industry standards to protect your information, no system is entirely impenetrable.

Incidental Charges & Damages: By providing your payment method, you authorize Host My Vacation to charge your card for incidental charges or property damage claims up to $500.00 submitted by the Host within 14 days following checkout.

Traveler Cancellations: Cancellation policies dictate the eligibility for refunds and are established by the respective Host or Service Provider. These policies are clearly displayed on the listing page prior to booking. To initiate any cancellation, contact our customer support team directly at 1-855-216-7400.

Host Cancellations: If a Host or Service Provider cancels a confirmed booking, Host My Vacation will make reasonable efforts to assist the Traveler in finding alternative accommodations or services of a similar standard.

Chargeback Policy: Host My Vacation operates a strict policy against fraudulent chargebacks ("friendly fraud"). Before initiating a chargeback with your bank or credit card company, you must contact Host My Vacation to attempt to resolve the issue.

Content License: By posting reviews, photos, or other user-generated content on the Platform, you grant Host My Vacation a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute that content.

Copyright Infringement (DMCA): Host My Vacation respects the intellectual property of others. If you believe your copyrighted work has been copied in a way that constitutes infringement, please send a written notice to info@hostmyvacation.com.

Disclaimer of Warranties: The Platform and all services are provided on an "AS IS" and "AS AVAILABLE" basis. Host My Vacation expressly disclaims all warranties of any kind.

Limitation of Liability: To the maximum extent permitted by applicable law, Host My Vacation shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Platform.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New York, USA.

Mandatory Arbitration and Class Action Waiver: ANY DISPUTE SHALL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. YOU AND HOST MY VACATION AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY.
